Rewards Terms and Conditions

Tropic Tan Rewards is a loyalty rewards program ("Program", or "Loyalty Program", or "Rewards Program") offered at the sole discretion and exclusively by Tropic Tan Ltd  ("Tropic Tan", "we", "our" and "us").

 By participating in the Program, you agree to be bound by the following Rewards Program Terms and Conditions ("Terms and Conditions") and Tropic Tan's General Terms and Conditions (See: www.tropictan.co.nz/pages/termsandconditions), each of which is a legally binding contract between you and Tropic Tan regarding your participation in the Rewards Program. Interpretation of these Terms and Conditions shall be at the sole discretion of Tropic Tan, whose decisions will be final.

 

  1. ELIGIBILITY

To participate in the Program, you must be at least eighteen (18) years of age or older or have reached the age of majority in your state, province, or territory at the time of participation, and be able to provide a unique and valid e-mail address at the time of enrolment. Only legally competent individuals to enter into contracts are eligible to be Members; corporations, groups, and associations are not eligible to participate in the Program. Any associated members of Tropic Tan's retailers or stockists program are also not eligible to participate. Tropic Tan reserves the right to limit the number of Members in the Program. 

Tropic Tan, in its sole judgement, reserves the right to disqualify any person from participation in the Program or revoke issued Points or Rewards, for any reason, including, for example, if that person appears to be violating these Terms and Conditions, making purchases for a business or for resale, manipulating the Program, making excessive returns, engaging in fraud, abusing Rewards privileges, or otherwise acting in a manner inconsistent with the Program's intent or for any other reason Tropic Tan deems necessary based on its sole discretion. 

If a Member is disqualified, such Member will forfeit their Points and all outstanding Rewards, as those terms are defined below, with a balance that has not been redeemed at the time of such disqualification.

 

  1. SIGNING UP TO TROPIC TAN REWARDS

Tropic Tan Rewards allows its eligible Members (each a "Member" or "you" or "your") to earn Points (defined below) redeemable for promotional product or discounts ("Rewards") for use towards future purchases when a Member shops on www.tropictan.co.nz and/or its associated websites. There is no cost to sign up to the Program, and no credit card application is required. Enrolment and participation in the Program are only available on www.tropictan.co.nz.

To participate in the Program, you must create an account on the participating Tropic Tan Website ("www.tropictan.co.nz"). Eligible individuals may enrol by following the instructions at the Tropic Tan Website to provide the requested information (e.g., an e-mail address and password (your "Login Credentials") and agree to the Terms and Conditions. In addition, you may opt out of the Program at any time by emailing tropictanofficial@gmail.com with a request.

Members must provide all required information to be enrolled and eligible to earn Points and Rewards and must have a device that is capable of accessing the Internet to access and use the Rewards Program. After the Member Account is created and account information confirmed by Tropic Tan, the Member becomes eligible to participate in the Program and earn Points to obtain Rewards. A Member may maintain only one Member Account. If an individual opens more than one Member Account, Member will only receive Points for the account opened first. Duplicative Member Accounts may be cancelled, and all Points and/or Rewards earned under the duplicative Member Account(s) may be forfeited.

 Each Member is solely responsible for all activities that occur under Member's Account and for maintaining the security of your Login Credentials. If your Member Account is compromised, you agree to inform Tropic Tan immediately. Members must not disclose Login Credentials to any third party for any reason. Tropic Tan will not be liable for any loss or damage of any kind arising from a Member's failure to comply with the requirements of this paragraph or any Member responsibilities under the Terms and Conditions.

 

  1. EARNING YOUR POINTS

After you have been enrolled in the Program, you will have the opportunity to earn or receive rewards points ("Points") for every dollar of Net Purchases on any participating Tropic Tan Websites. As used herein, "Net Purchases" means your purchases - less all sales tax, shipping and handling fees, returns, price adjustments, redeemed Rewards, and other discounts. To receive your Points on the Websites, you must be logged into your account before checking out. Points will be posted to your account one day from the date the order is placed.

Points may also be earned for other activities (each, a "Qualifying Activity") as specified by Tropic Tan from time to time. For each Qualifying Activity completed, the Member will receive a pre-determined and pre-announced number of Points, as determined by Tropic Tan in its sole discretion. An example of Points that may be earnt is as follows:

Points received via performance of Qualifying activities will be automatically added to the Member's account when all criteria for the activity has been fulfilled. If you suspect that you may have points missing, please contact tropictanofficial@gmail.com.

If Points are earnt via a “Following” Qualifying Activity then the following applies:

  1. Members may be eligible to receive points for following Tropic Tan’s nominated social media accounts.
  2. Points will be received when you click through to the relevant social media platform from within the Rewards Program Page and perform the Qualifying activity.
  3. Member must be signed into their Rewards account before performing the Qualifying Activity.

If Points are earnt via a “Share” Qualifying Activity then the following applies:

  1. Members may be eligible to receive points for sharing Tropic Tan’s nominated social media accounts on the Members social media accounts.
  2. The Points will be awarded when you share the page from within the Rewards Program Page.
  3. Member must be signed into their Rewards account before performing the Qualifying Activity.

If Points are earnt via a “Website Product Review” Qualifying Activity then the following applies:

  1. Members may be eligible to receive points for reviewing Tropic Tan’s products on the Tropic Tan website.
  2. A maximum of 1 review per person, per email address, every 30 days.
  3. Member must be signed into their Rewards account before performing the Qualifying Activity

If Points are earnt via a “Refer a Friend” Qualifying Activity then the following applies:

  1. Members may be able to refer a friend ("Friend") to the Tropic Tan customer base to earn 50 points into their account.
  2. The Friend must be a new customer of the Websites and have never purchased on the Websites before
  3. The Friend will receive a discount code to use on their first order.
  4. Upon the Friend placing their first order, using the discount code and paying in full, the Member will receive their 50 points.
  5. There is no limit to the number of Friends that the Member can refer.

 

  1. LIMITATIONS AND EXCLUSIONS ON QUALIFYING ACTIVITIES.

 From time to time, Members may be able to earn Points or other Program benefits by engaging in Qualifying Activities such as uploading photos, performing posts, reviews, comments, shares, follows, Tweets, re-Tweets, or similar ("Member Content") on the Tropic Tan Websites or third-party websites such as Facebook, Instagram, Pinterest, TikTok, Twitter, etc. ("Promotional Channel(s)"). All Member Content is subject to these Terms and Conditions, including the below limitations and exclusions:

  1. Member Content must be in English, may not include gibberish, nonsense keywords, random characters or hyperlinks to sites or content unrelated or not relevant to Tropic Tan or its business.
  2. Member Content must not be posted which is derogatory, includes profane or vulgar language, or prohibited personal attacks.
  3. Inappropriate online social media activity posted in connection with the Rewards Program is prohibited, and Tropic Tan has the sole discretion to determine what constitutes inappropriate social media activity.
  4. Member represents and warrants that its Member Content: (a) (other than content originally shared by Tropic Tan with Member) is Member's own original work, and does not contain any material that violates or infringes another's rights, including moral rights, rights of privacy, publicity or intellectual property rights; (b) has not been submitted previously in any promotion of any kind or exhibited or displayed publicly through any means or media; (c) if a photograph, depicts Member only (if at all), and no other persons; (d) does not identify, reference or depict any competing team, franchise or brands, products or services, including by means of prominent trademarks (including words, logos or designs), other than those owned by Tropic Tan; and (e) does not disparage Tropic Tan or any party or agent affiliated with this Rewards Program, or include words or graphics that are offensive, lewd, hateful or defamatory of any person or group, or contain any elements or gestures that, as determined by Tropic Tan, in Tropic Tan's sole discretion, are negative, obscene or inappropriate. All third-party content and content unoriginal to you, other than the content provided by Tropic Tan, is prohibited.
  5. Tropic Tan will not tolerate hateful or discriminatory speech, inappropriate language, or abusive activity of any kind. Any Member engaging in such activity in connection with the Rewards Program will have their Member Account cancelled, and any Points or Rewards due to Member will be forfeited.
  6. Any statement by a Member about a product or service offered by Tropic Tan and its subsidiaries or affiliates must be truthful, accurate and substantiated. Misrepresenting the benefits of a product is prohibited and may result in the cancellation of the Member's Account and forfeiture of any Points or Rewards due to Member.
  7. Any product review or endorsement by a Member, including but not limited to tweets and other social media activity, must be a truthful and accurate representation of the Member's opinion.
  8. You must disclose that you are participating in this Rewards Program or any related Promotion (if applicable) in any social sharing interaction that references the Rewards Program or a Promotion or is used to earn Points in connection with this Rewards Program or a Promotion. Tropic Tan reserves the right, in its sole discretion, to disqualify any Member who does not adequately disclose its participation in this Rewards Program or a Promotion while interacting with the Promotional Channels.
  9. Member Content must be publicly available.
  10. Member Content must comply with these Terms and Conditions and the terms applicable to users of each Promotional Channel to which it is submitted. In addition, it must be submitted by the registered subscriber of the applicable Promotional Channel account, to which the Member Content is uploaded.
  11. Use of fake Promotional Channel accounts, or accounts not registered to the Member using them for this Rewards Program, is prohibited.
  12. The creation of fake Members, via electronic or manual efforts, to obtain referral or recruitment Points is strictly prohibited.
  13. No robotic, software-generated, other automated, purchased, or incomplete Qualifying Activities will earn Points. Gaming, fraud or abuse relating to the earning of Points may result in forfeiture of accrued Points as well as the termination of a Member's account or this Rewards Program, in Tropic Tan's sole discretion.
  14. Member Content posted on Facebook, Twitter or other Promotional Channel, or actions on that Promotional Channel, posted, deleted, or liked, then unliked will not earn Points and will disqualify the posting Member.
  15. Member Content, including any posts, updates or comments that refer to Points being earned or rewarding another Member with Points, is prohibited and may result in disqualification.

In the event of a dispute over a Member's identity, the Member will be deemed to be the Authorized Account Holder of the e-mail address identified at enrolment into this Rewards Program. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute, social sharing site) that is responsible for assigning e-mail addresses for the domain associated with the applicable e-mail address.

 

  1. REDEEMING YOUR POINTS

You can redeem your Points for discount codes ("Rewards", "Reward") available in the Rewards section of our Rewards Program. Points value and Rewards are subject to change and any time and will be determined by Tropic Tan in its sole discretion from time to time. An example of Regards that may be offered is as follows: 

Rewards can be self-issued via our loyalty program by following the prompts to redeem Points for a Reward on the Website. Once you choose to redeem your Points for a Reward, you will be issued a discount code. Only one Reward or discount code can be used per order. 

To redeem your discount code, you must navigate to the participating Website where your membership account is held. You must then add the item into your cart, then enter the Reward discount code and apply discount. You must spend at least $1 when redeeming your Reward on the Website. Standing shipping fees will still apply. 

Tropic Tan reserves the right to not take any responsibility when you do not enter and apply your Rewards discount code correctly before checking out.

Tropic Tan reserves the right to make any Reward unavailable at any time, without notice to the Member.

 

  1. EXPIRATION OF POINTS/REWARDS

Points and Rewards you receive but that are not redeemed will expire ONE (1) year from your last non-returned shipment or Qualifying Activity event, or when your participation in the Program ends, or whichever is earlier. Tropic Tan will communicate with the Member 30 days prior to their Points and Rewards expiring with the primary communication method that the Member has selected when signing up with Tropic Tan Rewards. You will forfeit all accumulated and unused Points if you close your account or your participation in the Program is terminated.

 

  1. GENERAL

By participating in this Program, you agree to the following:

  1. Members have no ownership interest in accrued Points or Reward, and Points or Rewards are not the property of Members.
  2. Points cannot be sold, are not transferrable, and may not be combined with any other accounts or any other rewards program.
  3. Points have no cash, trade or barter value.
  4. Actions taken before enrolment in the Rewards Program are not eligible to earn Points.
  5. You cannot earn Points for the following actions:
  6. Purchase of gift cards are not eligible to earn Points.
  7. Any gift with purchases are not eligible to earn points.
  8. Points earned on Net Purchases are rounded up. For example, if you spend $54.50 and receive 1 Point per dollar, you will receive 55 Points.
  9. You do not accumulate Points on the portion of your purchase that is paid with Rewards.
  10. The number of Points you may earn on specific purchases may vary as Tropic Tan may limit certain products or actions that are eligible to earn Points.
  11. Members shall have no claim against Tropic Tan based on failure of Points to appear in a timely manner.

From time to time, Tropic Tan may also sponsor contests, sweepstakes or other promotions ("Promotions") in connection with which it will identify specific actions and social media sites in the applicable official rules.

Tropic Tan reserves the right in its sole discretion, at any time during the duration of the Program, to change the number of Points awarded, or to award no Points, for purchases on the Websites or for Promotions or Qualifying Activities, to offer additional means of earning Points for a limited time or permanently, to provide point earning opportunities to select groups of Members, to delete any or all means to earn Points, or to limit the number of Points a Member may earn for a single transaction.

For any Returns and other adjustments, such as a price adjustment or order cancellation, Tropic Tan may adjust your Points balance accordingly. Points received for item(s) subject to an adjustment may be deducted from your Points balance by the corresponding amount of the adjustment.

If an account with a negative Points balance is cancelled or deactivated for any reason, any negative Points balance may be rolled forward indefinitely if your account is subsequently reactivated.

Tropic Tan's determination of the number of Points available to any Member hereunder shall be final and binding for all purposes. No Points will be awarded for purchases made on the Websites that are otherwise in violation of these Terms and Conditions. Points are not valid unless earned in strict compliance with the requirements of these Terms and Conditions and Program Rules, as interpreted and applied by Tropic Tan.

 

  1. MEMBERSHIP COMMUNICATION AND PERSONAL DATA

By joining the Tropic Tan Rewards Program, you agree to let us collect, use and disclose your data (including personal information) per our Privacy Policy and these terms and conditions.

 When you join the Tropic Tan Rewards Program, you agree to receive e-mail communications from Tropic Tan for: 

  1. Providing you with marketing, product and special offer information; and
  2. Notifying you of matters relevant to your Tropic Tan Rewards membership, including Points and rewards expiry.

You can opt-out of receiving these e-mails by clicking the 'unsubscribe button at the bottom of any Tropic Tan e-mail or updating your preferences in the account section.

 Alternatively, to opt-out of our emails or your Tropic Tan Rewards Program, you can send a request for your data to be deleted from our system via sending an email with your details to us at tropictanofficial@gmail.com.

 

  1. TERMINATION OF OR PROGRAM CHANGE.

The Program has no pre-determined termination date and may continue until Tropic Tan, at its sole discretion, elects to designate a program termination date. In its sole discretion, Tropic Tan may terminate the Program, in whole or in part, at any time, with or without notice, which may result in loss of accumulated Points and Rewards and the cancellation of all benefits and privileges associated with the Program. Tropic Tan reserves the right to limit, delete, expand, modify, or change any of the rules, terms, conditions, and benefits of the Program at its sole discretion, with or without notice. Changes may affect Member's Points and Rewards already accumulated. Your continued participation in the Program after any changes to these Terms and Conditions or the Program signifies your acceptance of such changes. Tropic Tan has the right to close your account for any reason. Tropic Tan reserves the right to suspend, modify or withdraw any Rewards or Program benefits if Tropic Tan believes, in its sole discretion, that Program manipulation, fraud, malfunction, error or any other cause beyond our control impairs or otherwise compromises the administration, security, fairness or integrity of the Program. We reserve the right to reject, revoke, cancel or suspend any Member Account, issued Rewards, or any and all unredeemed Points, or take any other action at our discretion, at any time with immediate effect and without written notice or liability to any Member, if we believe: (a) the Member has (1) violated any of the Terms and Conditions; (2) acted in a manner inconsistent with applicable law, regulations, or ordinances; (3) engaged in any misconduct or wrongdoing in connection with the Program; or (4) engaged in abusive, fraudulent, inappropriate, or hostile conduct in connection with the Program, or Tropic Tan or its Members or employees; or (b) Tropic Tan's provision of the Rewards Program or any associated benefits (including but not limited to Points, coupons, and product samples) to the Member may violate any applicable laws to which Tropic Tan is subject. Membership in the Program may be revoked at any time. If we deactivate your account due to abuse or manipulation of the Program, or for any other reason, or if you cancel or close your account or opt-out of the Program for any reason, your membership in the Program will terminate immediately, and your Points balance and any value remaining on issued Rewards will be forfeited.

 

  1. LIMITATION OF LIABILITY.

 By enrolling in the program and redeeming the rewards, the Member agrees that Tropic Tan and its affiliates and subsidiaries and its officers, directors, employees, representatives and agents (collectively, the "released parties") will have no liability or responsibility whatsoever for, and shall be held harmless by members or any person for, any liability for any injuries, losses or damages of any kind (including, without limitation, direct, indirect, incidental, special, consequential, or punitive or exemplary damages) to persons, including personal injury or death, or property arising in whole or in part, directly or indirectly, from any action taken or neglected to be taken concerning the program, including any rewards or points.

The released parties are not responsible for (a) loss or misdirection of, or delay in receiving any membership application, correspondence, points, or rewards; (b) theft or unauthorized redemption of points or rewards or use of a reward caused by circumstances beyond the reasonable control of us or our representatives/agents; (c) any acts or omissions of third parties; or (d ) any errors published concerning them, including, without limitation, any typographical errors, errors of description, and errors in the crediting or debiting of points or rewards to/from member accounts.

We reserve the right to correct, without notice, any errors. In no event shall the released parties be liable to you for any delay in or failure to perform due to causes beyond our control, including, without limitation, any act of God, an act of war, natural disaster, terrorism, epidemic, pandemic, or any act or omission of a third party. The sole remedy available to you in connection with the program (whether your claim is based in law or equity) shall be the crediting or re-crediting to your program account of points in an amount no more significant than the number of points at issue.

By participating in the rewards program or using any reward, you expressly assume all liability and responsibility for your participation. You agree that participation is solely at your own risk. This section will survive termination of members' participation in the program.

 

  1. RESOLVING DISPUTES

If a dispute should arise between you and Tropic Tan, we want to provide you with an efficient and cost-effective resolution. In our experience, almost all Member service disputes can be resolved to your satisfaction by our Member service team, reachable by e-mailing tropictanofficial@gmail.com.

If your dispute cannot be resolved using our Member service team, these Terms describe how we shall resolve the conflict. 

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND TROPIC TAN AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

 In any circumstances where the Agreement to Arbitrate Disputes permits Tropic Tan and a Member to litigate in court, these Program Terms shall be governed by and construed per the laws of Auckland, New Zealand, excluding its conflict of law rules, irrespective of which country the Member is from.
